Privacy Policy
Last updated: August 8. 2026
This Privacy Policy explains how Momentum Wellness LLC ("we," "us," "our"), operating under the Return to Sport brand, collects, uses, and protects your personal information when you visit our website, join our email list, or purchase our programs.
By using our website or providing us your information, you agree to the practices described in this policy. If you do not agree, please do not use our website or provide your information.
1. Who We Are
Momentum Wellness LLC is a limited liability company organized under the laws of the State of New Hampshire and registered as a foreign LLC in the Commonwealth of Massachusetts and the State of Hawaii. For the purposes of applicable data protection law, we are the data controller for the information described in this policy.
Contact for privacy questions or requests: sean@returntosportacademy.com
2. Information We Collect
We keep our data collection minimal. We collect:
Information you give us directly.
Your name and email address when you join our waitlist or email list, or when you contact us.
Information you include when you reply to our emails or message us.
Information collected when you purchase a program.
When you purchase a program, your purchase is processed through TrainHeroic and its payment processor. Payment card details are collected and handled by those third parties, not by us. We do not see or store your full payment card information. We may receive confirmation of your purchase, your name, and your email address.
Information collected automatically on our website.
Our website is hosted on Squarespace, which collects standard analytics information such as pages visited, browser type, device type, and general location, and may set cookies to do so. This helps us understand how our site is used.
Email engagement information.
Our email platform, Kit, records standard engagement data such as whether an email was opened or a link was clicked. We use this to understand what content is useful and to improve our emails.
We do not run advertising pixels or third-party ad-tracking on our website.
3. How We Use Your Information
We use your information to:
Send you the emails, updates, and program information you signed up for;
Deliver the programs and materials you purchase;
Respond to your questions and provide support;
Understand and improve our website, emails, and programs;
Process refunds and handle related requests;
Comply with our legal obligations.
[ATTORNEY FLAG: For GDPR, confirm the lawful basis for each processing purpose — e.g. consent for marketing emails, contract for program delivery, legitimate interest for analytics. Recommend counsel state these explicitly if required for the markets served.]
4. How We Share Your Information
We do not sell your personal information. We share it only with the service providers that make our business run, and only as needed:
TrainHeroic — program delivery and payment processing.
Kit — email list management and delivery.
Squarespace — website hosting and analytics.
Teachable — delivery of certain bonus materials, where applicable.
ManyChat — if you interact with us through automated messaging on social media, that interaction is processed through ManyChat.
Each of these providers has its own privacy policy governing how it handles data. We may also disclose information if required by law, to protect our rights, or in connection with a business transfer.
5. Third-Party Platforms
When you purchase or use a program, your use of TrainHeroic and any other third-party platform is also governed by that platform's own privacy policy. We encourage you to review TrainHeroic's privacy policy for details on how it handles your data on its platform. We are not responsible for the privacy practices of third-party platforms.
6. Cookies
Our website uses cookies through Squarespace to support basic site functionality and analytics. Most browsers allow you to refuse or delete cookies through your browser settings. Doing so may affect how the site functions.
[ATTORNEY FLAG: If serving EU/UK visitors, a cookie consent banner may be required. Confirm whether Squarespace's cookie settings and any consent banner are configured to meet ePrivacy/GDPR requirements for the markets served.]
7. Your Rights
Depending on where you live, you may have rights over your personal information, including the right to:
Access the personal information we hold about you;
Correct inaccurate information;
Request deletion of your information;
Object to or restrict certain processing;
Withdraw consent to marketing at any time.
You can unsubscribe from our emails at any time using the link at the bottom of any email. To make any other request, email us at sean@returntosportacademy.com and we will respond as required by applicable law.
[ATTORNEY FLAG: GDPR (EU/UK) grants specific rights and response timelines, and may require identity verification and a defined response window. Confirm this section meets the requirements for all markets served, given worldwide sales. Consider whether additional CCPA/US-state-law language is advisable.]
8. International Users and Data Transfers
We operate from the United States, and your information is processed and stored in the United States and by our service providers. If you access our website or purchase from outside the United States, including from the European Union or United Kingdom, you understand that your information will be transferred to and processed in the United States.
[ATTORNEY FLAG: International data transfers from the EU/UK to the US have specific requirements. Confirm the appropriate transfer mechanism and disclosure, and whether the service providers named above provide adequate safeguards.]
9. Data Retention
We keep your personal information for as long as needed to provide our services, maintain your access to purchased programs, comply with our legal obligations, and for legitimate business purposes. You can request deletion at any time as described in Section 7.
10. Security
We take reasonable measures, and rely on the security measures of our service providers, to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Children
Our website and programs are intended for adults and are not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
12. Changes to This Policy
We may update this Privacy Policy from time to time. The updated version will be posted here with a revised "Last updated" date. Your continued use of our website after changes are posted constitutes acceptance of the updated policy.

Implementation Notes — Sean (remove before publishing)
Where this lives: its own page on Squarespace, linked in your site footer, on the TrainHeroic sales page, and at the bottom of your emails (Kit usually auto-includes an address/unsubscribe block — make sure the policy link is there too).
Accurate as drafted based on what you told me: name + email into Kit, payment/app data via TrainHeroic, Squarespace analytics, ManyChat for DM automation, no ad pixel. If any of that changes — especially if you ever add a Meta or Google pixel for ads — this policy must be updated, because ad tracking is the highest-scrutiny item under GDPR.
Still to resolve:
Mailing address for Sections 1 and 13 (registered agent address recommended over home).
Attorney flags: lawful basis (Sec 3), cookie consent banner (Sec 6), rights/timelines and possible US state-law language (Sec 7), international transfer mechanism (Sec 8).
Confirm Squarespace cookie-consent settings are turned on for EU/UK visitors.
The honest read: your data handling is genuinely minimal and clean, which makes this low-risk. The attorney's job here is confirming the GDPR-specific representations (lawful basis, transfers, cookie consent) are worded to standard — not rewriting the whole thing. Bundle this with the Terms and the waiver into the one attorney review.6
