Terms and Conditions — Return to Impact

These Terms and Conditions ("Terms") govern your purchase and use of Return to Impact and any related products, programs, guides, or materials (collectively, the "Program") offered by Momentum Wellness LLC ("we," "us," "our"), a limited liability company organized under the laws of the State of New Hampshire and registered as a foreign LLC in the Commonwealth of Massachusetts, operating under the Return to Sport brand.
By purchasing or accessing the Program, you agree to these Terms. If you do not agree, do not purchase or use the Program.
1. Not Medical Advice
The Program is a fitness and exercise program. It is not physical therapy, medical treatment, or healthcare.
Although the Program was developed by a licensed physical therapist, your purchase and use of the Program does not create a clinician-patient or provider-patient relationship of any kind. We are not your physical therapist, physician, or healthcare provider. No such relationship is formed by your purchase, your use of the Program, or any communication with us.
The Program does not diagnose, treat, cure, or prevent any injury, illness, or medical condition. It is general in nature, is not tailored to you, and is not a substitute for individualized evaluation, diagnosis, or treatment by a qualified healthcare professional who has examined you in person. We have not evaluated you and do not know your medical history.
Always consult your physician or a qualified healthcare provider before beginning the Program or any exercise program. Complete any active course of rehabilitation with your own provider, and obtain clearance from your medical team for impact and plyometric activity before you begin. If you experience pain, discomfort, or any concerning symptom during or after the Program, stop immediately and consult a qualified healthcare provider.
2. Eligibility and Assumption of Risk
2.1 Age
The Program is intended for adults only. You must be at least 18 years of age to purchase or use the Program. By purchasing, you represent that you are 18 or older.
2.2 Prerequisites
The Program involves plyometric and impact-based exercise. It is intended only for individuals who:
Have been cleared by a physician for impact and plyometric activity;
Are not experiencing pain during everyday activity;
Can squat and lunge without pain;
Can get down to and up from the floor without difficulty;
Can stand from a seated position without using their hands and without pain.
If you do not meet all of these criteria, do not purchase or begin the Program. If you are experiencing pain in daily life, or have not been cleared for impact activity by a physician, the Program is not appropriate for you at this time.
Certain procedures and conditions may make impact activity inadvisable, including but not limited to joint replacement. It is your responsibility to confirm with your provider that impact activity is appropriate for you, and to follow any individual guidance you have received from your own clinician. The Program does not replace your rehabilitation.
By purchasing and using the Program, you represent and warrant that you meet all of the prerequisites above and have obtained appropriate medical clearance.
2.3 Assumption of Risk
Exercise carries inherent risk, including the risk of serious injury, permanent disability, and death. Plyometric and impact-based exercise carries elevated risk of musculoskeletal injury, including but not limited to strains, sprains, tendon and ligament injury, fractures, and re-injury of previously injured tissue.
You understand these risks. You voluntarily and knowingly assume all risk associated with your participation in the Program, whether known or unknown, foreseen or unforeseen. You are solely responsible for determining whether the Program is appropriate for you, for monitoring your own response to it, and for deciding whether to continue, modify, or stop.
2.4 Release and Waiver
To the fullest extent permitted by law, you release, waive, and discharge Momentum Wellness LLC, its members, officers, employees, contractors, and agents from any and all claims, demands, causes of action, damages, losses, or expenses of any kind arising out of or related to your use of the Program, including claims arising from injury or death, whether caused by negligence or otherwise.
3. What You Are Purchasing
3.1 License Grant
Your purchase grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Program for your own individual, non-commercial use.
3.2 Access
The Program is delivered through TrainHeroic and may include supplementary materials delivered by PDF or email. Your access is provided for as long as we continue to offer the Program and for as long as our third-party delivery platform continues to make it available. See Section 5.
3.3 Clinician and Coach Use
If you are a licensed clinician, coach, or trainer, your license permits you to review the Program, use it for your own personal training, and apply the concepts and principles within your own professional practice using your own independent professional judgment.
Your license does not permit you to distribute, resell, republish, or share the Program materials with clients, patients, or any third party, or to represent the Program as your own work. Each individual who wishes to use the Program must purchase their own license.
You remain solely responsible for your own professional decisions. Nothing in the Program constitutes clinical direction, supervision, or advice to you as a practitioner.
4. Intellectual Property
All content in the Program — including the exercise selection, sequencing, progressions, phase structure, videos, written materials, PDFs, guides, and any bonus materials such as Coaches Corner — is the intellectual property of Momentum Wellness LLC and is protected by copyright and other applicable law.
You may not:
Copy, reproduce, screen-record, download (except where expressly provided), or redistribute any part of the Program;
Share your account credentials or access with any other person;
Post, publish, or distribute Program materials publicly or privately;
Resell, sublicense, or commercially exploit the Program;
Remove or obscure any copyright or proprietary notice.
The sequencing and progression structure of the Program represents substantial professional work product and is a core protected asset. Unauthorized use or distribution may result in immediate termination of your access without refund, and may subject you to legal action.
5. Third-Party Platforms
The Program is delivered through TrainHeroic and may include materials delivered through other third-party platforms (including Teachable and email delivery via Kit). Your use of those platforms is governed by their own terms of service and privacy policies. We do not control those platforms and are not responsible for their availability, performance, data practices, or continuity.
If a third-party platform changes its terms, ceases operation, or becomes unavailable, we will make reasonable efforts to provide continued access to the Program by other means, but we do not guarantee it.
6. Refunds
We want you to feel confident in your purchase. We offer two ways to request a refund.
6.1 14-Day Window
You may request a full refund within fourteen (14) days of your purchase date, for any reason. Reach out to sean@returntosportacademy.com with your order details.
6.2 Completion Guarantee
If you complete the full Program and feel it did not deliver what it promised, you may request a full refund, provided that:
You completed the Program within SIX months of your purchase date; and
You request the refund within thirty (30) days of completing it.
6.3 How Refunds Are Handled
Refund requests are processed through TrainHeroic's support process and are reviewed individually. Refunds are issued to the original payment method and may be subject to the policies and timelines of our payment processor and delivery platform.
6.4 Chargebacks
Initiating a chargeback or payment dispute with your bank or card provider before contacting us may forfeit your eligibility for a refund and may result in termination of access.
7. Bonus and Additional Materials
Bonus materials — including Coaches Corner and any additional programs, guides, or add-ons offered alongside the Program — are governed by these same Terms, including the intellectual property restrictions in Section 4 and the medical disclaimers in Section 1.
Bonus materials may be offered on a limited-time basis. Availability of a bonus at the time of your purchase does not entitle you to bonuses offered at other times, and the inclusion of a bonus in a future offer does not entitle you to a refund or credit.
8. Pricing
Prices are subject to change at any time without notice. The price displayed at the time of your purchase is the price you pay. Price changes after your purchase do not entitle you to a refund, credit, or price adjustment. Promotional pricing is offered at our discretion and for limited periods, and we are under no obligation to extend, repeat, or honor expired promotional pricing.
9. No Guarantee of Results
We make no guarantee, representation, or warranty regarding any specific result.
Individual results depend on many factors outside our control, including your medical history, prior injury, adherence, effort, sleep, nutrition, age, and other individual factors. Testimonials and examples reflect individual experiences and are not typical, expected, or guaranteed results.
The Program is not a return-to-competition program and does not clear you for sport, competition, or high-level change-of-direction activity. Decisions about your readiness for any activity should be made with a qualified healthcare provider who has evaluated you.
10. Limitation of Liability
To the fullest extent permitted by law, in no event shall Momentum Wellness LLC or its members, officers, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits or revenue, arising out of or related to the Program.
To the fullest extent permitted by law, our total aggregate liability arising out of or related to the Program shall not exceed the amount you actually paid for the Program.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Momentum Wellness LLC and its members, officers, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use or misuse of the Program, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the Program at any time, without refund, if you violate these Terms, including the intellectual property restrictions in Section 4 or the eligibility requirements in Section 2.
13. Privacy
Our collection and use of your personal information is governed by our Privacy Policy, available at [PRIVACY POLICY URL].
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Massachusetts, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Program shall be brought exclusively in the state or federal courts located in Middlesex county MA, and you consent to the jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms at any time. The version in effect at the time of your purchase governs your purchase. Continued use of the Program after updated Terms are posted constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms constitute the entire agreement between you and Momentum Wellness LLC regarding the Program and supersede any prior agreements or understandings.
